These Terms and Conditions (“Terms”) apply to all onsite implementation services (“Services”) provided by Wisk-it, a brand of Bond Connect España S.L (“Service Provider”) to the customer identified on the invoice (“Customer”). By paying the invoice or permitting commencement of the Services, the Customer acknowledges and agrees to be bound by these Terms.
- Scope of Services
The Service Provider shall perform standard onsite hardware installation services, which may include unpacking, physical installation, cabling, initial configuration, connection to existing infrastructure, and basic functional verification. Services not expressly described are excluded. Any additional services requested will be charged separately. - Customer Responsibilities
The Customer shall:
a) Ensure all hardware to be installed is present on the premises prior to commencement of the Services;
b) Provide safe and adequate working conditions, including electricity, internet, physical space, and environmental controls;
c) Provide accommodation onsite if overnight stays are required, and cover meals (breakfast, lunch, dinner) as applicable;
d) Back up all data, software, and configurations prior to commencement;
e) Bear responsibility for compliance with all applicable laws and site rules; and
f) Reimburse the Service Provider for any additional costs or delays caused by the Customer, including rescheduling, idle time, or repeat travel. - Risk of Loss
All hardware remains at the Customer’s risk at all times. The Service Provider shall not be responsible for the custody, safekeeping, or insurance of hardware located on the Customer’s premises. - Acceptance and Post-Implementation Support
The Services shall be deemed completed upon the Customer’s written or verbal sign-off. A forty-eight (48) hour period of rapid support will be provided to address issues directly arising from the implementation. Thereafter, only standard support applies.
No warranty is provided for the Services beyond this period. Hardware purchased through the Service Provider remains subject to the refund and warranty policies published at: https://wisk-it.shop/policies/refund-policy. - Limitation of Liability
The Service Provider’s total liability shall not exceed the fees paid for the Services. The Service Provider shall not be liable for any indirect, incidental, or consequential damages, including loss of profits, data, or business. Nothing in these Terms shall exclude liability for gross negligence, willful misconduct, or death/personal injury caused by negligence - Indemnity
The Customer shall indemnify and hold harmless the Service Provider against any claims, damages, or expenses arising from: (i) misuse of the hardware or Services; (ii) failure to comply with applicable laws or site rules; or (iii) third-party claims caused by the Customer’s acts or omissions. - Force Majeure
The Service Provider shall not be liable for delays or failures due to causes beyond its control, including but not limited to natural disasters, labor disputes, acts of government, supply chain disruptions, or transportation delays such as flight cancellations. The Service Provider will use reasonable efforts to continue performance but shall not be responsible for resulting damages, delays, or costs. - Health and Safety
The Customer shall provide a safe working environment for the Service Provider’s personnel and disclose all site-specific health and safety requirements. The Service Provider shall not be liable for injury, loss, or damage arising from unsafe site conditions, except where caused by its gross negligence or willful misconduct. - Termination
The Customer may not cancel or terminate the Services once accepted, except with the Service Provider’s prior written consent. The Service Provider reserves sole discretion to determine whether termination may be granted and under what terms. - Governing Law
These Terms & Conditions shall be governed by and construed in accordance with the laws of Spain. The Parties submit to the exclusive jurisdiction of the courts of Badajoz, Spain, to resolve any dispute arising out of or in connection with these Terms & Conditions.
